Terms and Conditions
International terms and conditions are based on French regulations and you submit to them when you buy a product in our shop online. If you have any question, you may contact us by email.
1. Application of the General Terms and Conditions of Sale
By placing an order to Editions d'Art Daniel Derveaux through the shop online www.editionsdanielderveaux.fr, you confirm that you have read, understood and agree to these General Terms and Conditions of Sale in their entirety. If you do not agree to these General Terms and Conditions of Sale in their entirety, you must not order any product or service through the shop online.
2. Order
When placing an order with us you need to verify it before proceeding to the payment.
You confirm that all information and details provided by you to us are true, accurate and up to date in all respects and at all times. In the case of a misspelled name, adress, country or if any adress for the delivery is wrong, we won't be held responsible for your mistaken information. The extra charges for the delivery will be at your expenses and not ours.
Our acceptance of your order will take place only when we despatch the product(s) or commencement of the services that you ordered from us.
We will notify you by email as soon as possible to acknowledge that we have received your order and your payment and that we are processing your order. The duration of our contract with you will start from when you order and we take payment and dispatch the products, until the last day of your right to cancel.
3. International Delivery
International Delivery with "Sign for Delivery" by Colissimo - La Poste.
To spread in foreign countries, we have decided to give you the best delivery we can. Therefore, we take part of the delivery prices on our expenses (only one delivery address by order). If you have any question or if your country is not listed, please "contact us" at the bottom of the page. The volumetric weight has badly increased the price for sending outside the European Union and we will do our best to propose you the best secured delivery price. We will try to give you a quick answer. We shall be under no liability for any delay or failure to deliver products if the delay or failure is wholly or partly caused by circumstances beyond our control.
Delivery price for:
- Region 1 : France, Andorre, Monaco (delivery within 5 business days): 5 €
- Region 2 : Germany, Luxemburg, Belgium, Netherlands (delivery within 8 business days): 9 €
- Region 3 : Italy, Ireland, Portugal, Spain, Austria, Malta, Denmark, Hungry, Poland, Czech Republic, Slovekia, Slovania, Estonia, Lithuania, Latvia, Sweden, Romania, Bulgaria, Finland (delivery within 10 business days): 12 €
- Region 4 : Switzerland, United Kingdom (delivery within 10 business days): 15 €
4. Price and payment
The sales contract shall be deemed to have been concluded only at the time of debiting the consumer’s account. No delivery will be made without payment of order.
Payment methods:
1/ DEBIT/CREDIT CARD, secure payment via your bank by Paypal (without having to create a Paypal account).
2/ PAYPAL.
The price are in euros including all taxes and without the delivery price. If your delivery occurs inside the European Union, you will be charged with the current French VAT for the product and for the delivery. If you live outside the European Union, you will be charged without VAT for the product and for the delivery. Exceptions for Andorre and Monaco which have the delivery with VAT and the products without VAT. For the delivery outside France, the possible local taxes or custom charges will be at your expenses.
5. Return Policy.
According to the law Hamon, 14 juin 2014, which only applies in the European Union, the customer has a retraction period of 14 days after receiving the product. The customer may use this right of retraction by sending us an email or a fax informing his decision to cancel the sale contract. The product shall be returned at your expenses. No product shall return without being authorized by our services. Please contact us if you need more information. The repayment to the customer will come within 14 days after the return of the delivery to our company.
6. Intellectual property and copyrights
The shop www.editionsdanielderveaux.fr is the property of Editions d'Art daniel Derveaux, SARL Editions d'Art Derveaux. Any reproduction, even partial, of the shop, the texts and the products presented in it is absolutely forbidden. We may use legal proceedings.
All the products sold by Editions d'Art Daniel Derveaux, SARL Editions d'Art Derveaux on the shop ww.editionsdanielderveaux.fr and outside the shop are protected by copyrights for the maps, the drawings, the engravings, the books and the visual of the by-products. The customer will not reproduce or copy them, otherwise he will be hold responsible for it and prosecution or civil action against him or her shall be pursued.
Our products are protected by :
- The Code of Intellectual Property (CPI): According to the articles L111-1 and L123-1 of the CPI, the author, during his life, has the right of using his work in any possible form and to gain a pecuniary advantage with it. When he dies, this right runs 70 years after his death to the legal successors. Daniel Derveaux (1914-2010), being deceased in 2010, the protection of his work runs until 2080. Pierre Derveaux (1945-......), still alive, his work is protected and will be for many years to come.
- The Convention of Bern for the intellectual property right of the conventional duty directed by the World Intellectual Property Organization (WIPO).
7. Guarantee- Insurance- Force majeure
The Editions d'Art Daniel Derveaux for The SARL Editions d'Art Derveaux take all the possible and reasonable care to satisfy the customers. Our responsability is limited to the price of the product (not including the delivery price). Therefore, we take no responsibility for the bad care or the negligent storage you may do or have done with our products. We are insured by common law.
The Editions d'Art Daniel Derveaux for the SARL Editions d'Art Derveaux will not be held responsible in the case of force majeure. The following shall be considered herein as events of force majeure constituting cause for the cancellation or suspension of the seller's contractual obligations, without any right of recourse for the buyer : accidents affecting the manufacture or storage of the products, total or partial interruption of supplies of raw materials or energy, fire, flooding, lightning, hurricane, cyclone, storm, breakdown of machinery, total or partial strikes, administrative decisions, acts attributed to third parties, boycotts, lock-outs, civil or/and military war and all and any external occurrences likely to delay or prevent the performance of the seller's obligation or to render such performance economically exorbitant.
8. Applicable law
The applicable law is French law. All disputes concerning the sell of our products will be subject to the exclusive jurisdiction of France, Deux-Sèvres, in Niort. Any interpretation in the Terms and Conditions is to be made exclusively in French.
9. Entire Agreement
You confirm that, in agreeing to accept these terms and conditions, you have not relied on any representation save insofar as the same has expressly been made a term of these terms and conditions and you agree that you shall have no remedy in respect of any representation.
By ordering to editionsdanielderveaux.fr and by paying the order, the Terms and Conditions listed above are fully accepted by the customer/buyer who declares to have read, understood and accepted our Terms and Conditions.
